Fundamental problem with intellectual property...    2010-06-22 11:45:34 ET
What is the United States gonna do? an interesting question when it comes to ideas aka intellectual property. If one person gets an idea and you get wind of it, is it right for that person to prohibit you from using it. For the sake of money that person will attempt to do so but is it fair. Ideas can be quite the movers and shakers but is it right for a government to control the flow of intellectual property.

What is the United States gonna do? Will is adopt the ways it fought against during the cold war. Will it become like China and monitor your behavior and begin censorship. The problem with the United States is that its laws do not span across the whole world.

The problem that the United States has is that if one country chooses not to enforce copyright law and starts to freely publish intellectual work such as movies, music, literature, etc. it can not be stopped unless the United States begins to censor the internet.

And it is a fundamental problem that will challenge the constitution's freedom of speech. What was the intention for freedom speech. Back in the mid-evil day Kings censored literature because it challenged their control over their conquered land. Big media companies today issue licenses to control their intellectual work and depend on the government to enforce them. The question is, will the government begin to censor its citizens in order to protect big media.

Alas the US government does not span across the whole world. Other countries can choose not to follow our laws and they shouldn't be penalized for it. If these other countries should decide to re-publish all the intellectual work they acquire by perfectly legit means what's the United States going to do?

Is the US government willing to tell its citizens not to take any intellectual property with them to countries that do not comply with our laws? Is the US government willing to tell all of the tourist not to take any intellectual property with them when they go back home?

What's the United States going to do? Its an interesting question... And the thing is that if other contries decide to put up movies for other people to see they will not be the ones breaking the law. Its the American citizen that will be breaking the laws should they choose to watch those movies.
